Option Agreements & Overage Clauses

Commercial Property Options

As landowner or developer you may be involved in granting or taking an option over land, a right of a pre-emption (right of first refusal) or wish to enter into a conditional contract to buy or sell land (e.g. your purchase may be subject to the grant of planning consent for a new use of the land or for development).

Such agreements are frequently complex and detailed. We have the knowledge and experience to advise you and will work with your planning consultants and/or other professional advisors as required.

Commercial Property Overage

Overage (or uplift) is a complex area.

You may be buying or selling land subject to a provision designed to enable the seller to benefit from future enhancement of the land value (e.g. if planning permission is obtained for a specified alternative use). We will be able to advise you and deal with such transactions whether you are selling or buying. We will also work closely with your selling agents and/or planning consultants as needed.

Whatever your query, our specialist lawyers are here to guide you through each stage of the legal process, providing straightforward, practical, cost-effective advice. It costs nothing to pick up the phone or email us to find out more.
