An ex-premiership footballer has been awarded £1.5 million for the unnecessary surgery carried out upon the recommendation of his surgeon.
Michael Appleton, a former Manchester United trainee, suffered a partial tear of the posterior cruciate ligament of his right knee during training. This should have been treated conservatively with a knee brace and physiotherapy. However, his surgeon advised him to the contrary and the resulting operation forced him to retire from professional football at the age of 26.
The case itself was littered with celebrity expert witness evidence from former manager Sir Alex Ferguson and England full-back Gary Neville who testified that Appleton had a potentially great career ahead of him with a potential income of £500,000 per year for the remainder of his professional life.
Unnecessary or negligently performed operations can have catastrophic consequences for those they are performed on. Bringing claims against the hospital at fault ensures that their procedures are reviewed and therefore ultimately, conducted at a higher standard, hopefully making it far less likely that a similar injury will occur again.
Metcalfes are experienced in dealing with high value claims involving significant injuries as a result of clinical negligence.
