FAQ's - Contract of Employment

I have been working for my employer for three months but I have never been given a contract. Is this ok?

Within two months of an employee commencing employment, the employer must give the employee a written statement of terms and conditions relating to:

  • The scale and rate of remuneration or the method of calculating remuneration


  • The intervals at which remuneration is paid i.e. weekly, monthly etc


  • Any terms and conditions relating to hours of work


  • Terms and conditions relating to holidays


  • Terms and conditions relating to sickness or injury


  • Terms and conditions relating to pensions and pension schemes


  • Length of notice to terminate employment required from either party


  • Holidays


  • Job title


  • Length of employment i.e. permanent or fixed terms


  • Place of work


  • Any collective agreements


  • Whether or not required to work outside the UK for more than one month


Do all employment terms have to be set out in my contract?

No. Terms can be written, oral, implied or a mixture of all three.

Implied terms might include those that are too obvious to be expressly agreed e.g. a term that the employee must accept reasonable instructions from the employer, those that are necessary to make the contract workable and those that are established by custom and practice in the particular organisation or industry concerned.
